Terms and Conditions

These Terms and Conditions (“Agreement”) govern the use of dress hire services and the purchase of products provided by QYN (“Company”) to the customer (“Customer”) in Australia. By accessing and using our services, the Customer agrees to be bound by the terms and conditions outlined in this Agreement.
In these Terms and Conditions, the use of “You”, “your”, and “client” refers to the customer (“Customer”). “QYN”, “we”, “our”, and “us” refers to Vuch Pty Ltd trading as QYN (ABN 60 658 411 360) (“Company”)
Dress Hire Agreement
1.1 The Customer acknowledges that they are hiring the hired items from the Company for a specified period from the Start Date to the End Date, as agreed upon during the booking process.
1.2 The hired items will always remain the property of the Company and should be returned in the same condition as when hired, normal wear and tear excepted.
1.3 If the Customer is under 18 years old, the Customer represents and warrants in favour of the Company that the Customer have reviewed and understood these Terms and Conditions with their parent or legal guardian.
Booking and Payment
2.1 The Customer agrees to provide accurate and complete information during the booking process.
2.2 The Customer must pay the hiring fee in full (or a lesser amount agreed by the Company) to secure and confirm the dress hire booking. The payment confirms the Customer’s acceptance of these Terms and Conditions.
2.3 Any request to change the dates of the hiring period from the Customer after the booking is confirmed may be considered by the Company on a case-by-case basis and are subject to the sole discretion of the Company.
2.4 The hiring fee payments are not refundable if the Customer cancels or abandons the booking due to their change of mind or their change in personal circumstance.
2.5. The hired items may be hired out to other customers before the Customer’s scheduled hiring period. The Company will endeavor to maintain the hired items in a reasonably good condition suitable for hiring.
2.6 Garment size adjustments (if requested) are best efforts only according to the measurements taken during the booking process. The Company does not adjust the garment size or length unless it is explicitly noted and agreed by the Company.
2.7 The Customer can change the booking to hire different items at least two(2) weeks before the Start Date of the hiring period by paying a $50 administration fee plus any difference in hiring fee for the new items. The Company does not offer refunds when the hiring fees of the new items are lower than the original items.
Pick up and Return
3.1 The Customer will pick-up the hired items from the Company’s store during its trading hours on the hiring period Start Date specified in the booking.
3.2 If the Customer has requested the hired items to be posted, the Company will post the hired items by Australia Post Express Post services on the Start Date of the hiring period. The Company does not guarantee the timeliness of the Australia Post delivery. The customer uses this service delivery method at their own risk.
3.3 The Security Bond of the hired items are due before the hired items will be released for pick-up or postage. The Customer can pay the Security Bond in cash, EFTPOS (surcharge applies), or a pre-authorisation on a compatible credit/debit card. The Company will refund or release the pre-authorisation on the Security Bond to the Customer within 5 business days after the hired items are returned in line with these terms and conditions.
3.4 The Customer must return the hired items to the Company’s store by the End Date of the hiring period. Late returns may incur additional charges outlined in Clause 4.
3.5 If the Company has agreed to the Customer to return the hired items by post, the Customer must lodge the return postage with Australia Post Express Post at their own cost by the hiring period End Date.
3.6 The Customer must return the hired items in the same condition as when hired, free from damage or any alterations. The Company reserves the right to charge the Customer for any damage or alterations beyond normal wear and tear.
3.7 The booking is abandoned if the Customer does not pick up the hired items during the hiring period. Our service to the Customer is deemed to have completed.
3.8 If the Company cancels the booking or is unable to provide the service as agreed upon due to unforeseeable circumstances (e.g. late returns, damage or loss of the hired items), the Company will do its best to make alternative arrangements for the Customer, or the Company will refund the Customer any hiring fee and security bond paid.
3.9 The Company is responsible to clean the hired items after the Customer have returned them. The Customer must not to attempt to clean the hired items.
Late Returns and Cancellations
4.1 If the Customer fails to return the hired items by the agreed End Date of the hiring period, a late fee of $100 for every additional day late applies.
4.2 In the event of cancellation and abandonment by the Customer, the Customer will not be eligible for a refund of any hiring fee paid, but any applicable security bond paid will be refunded.
Liability
5.1 The Customer agrees to take full responsibility for the hired items from the time of pick-up until they are returned to the Company.
5.2 The Customer agrees to use our services at their own risk. To the extent permitted by law, the Company will not be liable for any direct, indirect, incidental, special or consequential loss or damages caused by using our services.
5.3 If the hired items are returned with minor damage (small, non-structural damages), irremovable staining (permanent stains that cannot be removed through standard cleaning methods), or alterations without the Company’s consent, the Company will charge the Customer the repair or replacement costs at the sole discretion of the Company.
5.4 The hired items always remain the property of the Company. If the hired items get lost, stolen, damaged beyond repair, or not returned to the Company within 7 days of the hiring period End Date, the Company reserves the right to recover the replacement cost of up to 500% the hiring fee from the Customer.
5.5 The Customer authorises the Company to charge any outstanding monies owed by the Customer by debiting the credit/debit card details stored on the Company’s system. The Company will notify the Customer via email before charging any outstanding fees to their credit/debit card.
Privacy and Data Protection
6.1 The Company will handle any personal information provided by the Customer in accordance with its Privacy Policy as available on the Company’s website.
6.2 The Customer acknowledges that the Company may collect, store, and use their personal information for the purpose of providing the dress hire services and related activities.
Governing Law and Jurisdiction
7.1 This Agreement shall be governed by and construed in accordance with the laws of Australia.
7.2 Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.
Policy for Purchase of Pre-Owned Products
8.1 This condition applies to Customer purchasing pre-owned products outright from the Company. The Customer agrees to purchase the pre-owned products in its current condition as-is, that may show signs of wear or imperfections consistent with previous use. The Company does not offer any other warranties, returns, refunds or exchanges that the Australian Consumer Law does not guarantee. If you believe your purchase qualifies for a claim under the Australian Consumer Law, please contact QYN by email to initiate the process. The Customer will cover any return delivery and the dispatched cost in the event of a claim.
